MEMORANDUM
OF AGREEMENT
This Memorandum of Agreement
is entered into as a manifestation of an effort to provide technical vocational
education and training and competency assessment to individuals and
organizations utilizing the manual on the application of science and technology
to the natural farming and organic agriculture systems authored by Dr. Silvano
B. Maranga. The parties through this mutual agreement expressed their desire to
jointly support the programs for knowledge, education and wellness and hereby
depose and say that
Farm owner, Mr. Renante A. Maranga,
of legal age, Filipino, with residence at Purok 8, Poblacion, Nabunturan.
Compostela Valley, Davao Region, herein referred to as the FIRST PARTY;
and
ACTION FOR SKILLS KNOWLEDGE
EDUCATION AND WELLNESS CENTER CORP, a Private Educational Institution, existing
under the laws of the Republic of the Philippines, with TESDA registered
programs, and extension business address at
Purok 2, Linoan, Montevista, Compostela Valley whose main office at Barangay
Bongdo, Borbon, Cebu represented by its President / CEO , Dr Silvano B. Maranga
herein referred to as the SECOND PARTY;

WHEREAS, the FIRST PARTY, is
the owner of Maranga Farms, situated in Purok 2, an agri-fishery facility involved in the production
of fresh water fish, horticulture and animal raising;
WHEREAS, the PARTY OF THE
FIRST PART, is interested in developing skills training programs for the
community and the agri-fishery sector;
WHEREAS, the FIRST PARTY, is continuously in
search of partners to support the effort on developing linkages for quality
training, elevate the standards and employment of graduates in both self and wage
employment modalities;
WHEREAS, the SECOND PARTY is a private educational
technical organization designed to engage in training in various trade skills
in industrial, agricultural and tourism
sectors and trade skills.
WHEREAS, the SECOND PARTY,
is a training institution authorized to
collect training fees, accept training grants and scholarships of which the
grantees are either individuals or organizations to be provided with skills
training and competencies for decent
work;
WHEREAS , the SECOND PARTY,
registered with SEC registration number CN 201326762 dated June 6, 2013, BIR
Registered with TIN 442-639-432-000; with TESDA registered programs;
WHEREAS, the SECOND
PARTY commits itself to share training
resources, technology, utilize equipment and other facilities of the party in
the conduct of skills training for the students / trainees;
THEREFORE, all the Parties
believed in the collective efforts to conduct a quality skills training for the
trainees, develop products and services for community empowerment through
science and technology and engage in self- employment ventures in agro
-industrial sectors and provide companies and communities the best workers for
the jobs, adhere to the following terms
and conditions;
TERMS
AND CONDITIONS
1.
THE
FIRST PARTY SHALL:
1.1
Provide venue as off-campus facility and
support the Mobile Training Program of Action for Skills Knowledge Education
and Wellness Center Corp and share the use of equipment, materials, technical advice, skills training inputs for
a quality and safe conduct of skills training under the supervised work-based
learning system;
1.2
Provide support staff to ensure that
facilities are in good working condition based on schedules agreed upon among
trainors, trainees and the party of the second part;
1.3
Assist in the provision of tools, materials
which are deemed necessary to ensure conduct of quality training AND COMMUNITY
–BASED RESEARCH FOR THE AGRICULTURE AND AQUATIC RESOURCES and facilitate the
TECHNOLOGY TRANSFER OF THE COMMUNITY-BASED TECHNOLOGIES and shall assist in the
sourcing out of additional equipment, such as engine, water compressor pump, farming tools, wheel borrow, and
materials, such as feed for the fish, fertilizer for the plants and feed
materials for the animals for use by the trainees in the off-campus facility of
the first part; and other items needed for the acquisition of competencies.
1.4 Assist trainees in
industry immersion and on-the-job training;

THE
SECOND PARTY SHALL;
2.1
Provide counterpart certified trainors to
conduct the competency-based training in various trades as registered with
TESDA;
2.2
Schedule the conduct of skill training for
an in-center/in-school ,off-campus training, industry immersion through
dualized approach to training and assist
the party of the first part to facilitate the industry immersion of students
AND FACILITATE THE CONDUCT OF A COMMUNITY-BASED SCIENCE AND TECHNOLOGY BASED
RESEARCH FOR COMMUNITY EMPOWERMENT;
2.3
Ensure the follow-up of learning through
the e-learning systems and computer based modalities;
2.4
In consultation with the FIRST PARTY shall
encourage participants to share training materials as part of the business
incubation program and preparation for entrepreneurship endeavors of graduates
2.5
Link the training programs in consultation
with the PARTY OF THE FIRST PART to legitimate TESDA registered institutions (such
as ACES Polytechnic College and Cebu Technological University) with good track
record to assist in the conduct of
training, skills assessment and employment;
2.6
Coordinate with TESDA for the conduct
of skills Assessment;
2.7
Provide support sessions on Safety,
Cultural differences, health and wellness;
2.8
The
SECOND PARTY SHALL also share or source other available items in the event of
expansion and increase in enrollment in various trade skills
2.9
The
second party shall respond to the legitimate request of the first party and the
community or Barangay Leaders of Provinces of Davao Region and Barangay Bongdo,
Borbon, Cebu on matters pertaining to training in production, and possibilities
of developing a house in the garden program of CWL and farm tourism endeavor in self-employment and
community based research for science and technology;
OTHER
PROVISIONS:
2.10
That this Memorandum of Agreement (MOA)
shall be enforceable within a period of
five (5) years reckoned from the time of signing and renewable at the
option of the Parties involved;
2.11
That Parties involved shall screen and
qualify trainee applicants, get the support of the local officials and shall
periodically check on the trustworthiness of trainees in handling training
facilities and training overall training performance,
2.12
That the Parties involved shall
periodically evaluate the skills competencies of trainees of the project and
enhance/update the provisions herein stipulated to effectively, efficiently,
and economically carry out the project and thereby succeed as envisioned; and
2.13
That any dispute arising from this MOA
shall be resolved amicably in the spirit of good will and best intentions in
serving God, Community and the Country
